01About these terms

These terms apply to the Nightjar app for Android and to this website, nightjarofficial.com. Both are published by Avalanche Byte, an independent developer based in Romania (“we”, “us”). By downloading or using Nightjar you agree to these terms. If you don't agree, please don't use the app.

Google Play's own terms of service also apply to how you download and update the app.

02Using the app

Nightjar is a free tool for planning shift schedules, tracking hours and estimated pay, and setting shift alarms. We give you a personal, non-exclusive, non-transferable licence to install and use it on devices you own or control, for as long as you follow these terms.

03Alarms and reminders

Nightjar is built to wake you up: it rings a full-screen alarm before each shift and checks the phone settings that commonly stop alarms. But an alarm can still fail for reasons outside the app's control, including a switched-off, silenced or flat phone, Do Not Disturb, battery optimisation, operating-system updates, or restrictions added by the phone's manufacturer.

Please don't rely on Nightjar as your only way of getting to a shift on time. To the extent the law allows, we are not responsible for missed, late or disrupted shifts, or for any consequences with your employer.

04Hours, pay and overtime are estimates

Nightjar calculates hours, earnings and overtime from the rates, premiums and rules you enter. These figures are estimates for your own planning. They are not payroll, tax, legal or financial advice, and they may differ from what your employer pays. Always check your payslip and your contract; your employer's records prevail.

05Shift patterns and public holidays

Rota templates and public-holiday calendars are provided for convenience. Your employer's rota and your local holiday rules may differ, so check with your workplace if anything looks wrong.

06Advertising

The app is supported by ads served by Google AdMob. Ads are provided by third parties; we don't control or endorse the products advertised. Watching one optional sponsor message in Settings turns ads off for 24 hours. How ad data is handled is described in our privacy policy.

07Your data and backups

Your schedule and settings are stored on your device, as explained in the privacy policy. Because we hold no copy, keeping a backup is up to you: the app includes backup and restore so you can move your rota to a new phone. When you share your rota as an image, a calendar export or a share code, you choose who receives it.

08Fair use

Please don't copy, modify, redistribute or resell the app, remove its notices, interfere with how it shows ads, or reverse-engineer it, except where the law expressly allows you to. Don't use Nightjar for anything unlawful.

09Ownership

The Nightjar app, its name, logo and design, and the content of this website belong to us. Google Play and the Google Play logo are trademarks of Google LLC.

10No warranty, and limits of liability

Nightjar is provided “as is” and “as available”. We work hard to keep it accurate and reliable, but to the extent the law allows we don't promise that it will be error-free or uninterrupted, or that it fits every rota.

To the extent the law allows, we are not liable for indirect or consequential losses, including lost wages, missed shifts or disciplinary action. Nothing in these terms limits liability that cannot legally be limited, such as liability for death or personal injury caused by negligence, or for fraud.

If you are a consumer in the European Union, the United Kingdom or elsewhere, you keep every right that your local consumer law gives you, and nothing in these terms takes those rights away.

11Changes to the app and these terms

We may update or change the app, and we may update these terms. When we do, we'll publish the new version on this page with a new date; continuing to use Nightjar after a change means you accept the updated terms. You can stop using Nightjar at any time by uninstalling it, and we may stop offering the app in the future.

12Governing law

These terms are governed by the laws of Romania, and disputes will be handled by the competent courts of Romania. This doesn't take away the protection of mandatory consumer laws, or your right to bring a claim in the courts, of the country where you live.
